Sales Contract & Limited Health

Seller represents that the puppy has no known disease or illness, and has no known congenital or hereditary conditions that would adversely affect the health of the pup at the time of sale or that is likely to adversely affect the health of the pup in the future. Kelly Pofahl of Pofahl Kennels is herein referred to as: breeder/seller.
Buyer agrees to have their puppy examined by a licensed vet within 72 hours of pick-up date or they forfeit any warranty.
SHIPPING : We prefer the puppy to be picked up in person, but we do ship weather permitting out of Los Angeles, CA. (LAX) to your nearest airport. The buyer assumes all costs, and liability related to shipping the puppy, that includes but is not limited to additional kenneling costs due to poor weather conditions on connection flights &/or flight delay charges. Liability of the seller is released once the puppy leaves the sellers address, on its way to the airport. The price to fly to any major airport is $300-$375 (subject to change without notice) depending upon airlines & destination airport, which includes airfare, crate, travel water & food bowl, veterinary health check, health certificate, shots up to date and delivery to the airport. When it comes to shipping your Chihuahua, the breeder/seller is in no way responsible for the death or injury to the dog or loss of the dog during transport to its new home. The buyer will need to settle with the airlines or ground transport company. We do offer flight insurance for an additional fee. If you want to purchase flight insurance please request it in writing no less than 10 days prior to shipping. We do everything possible to make sure the pup has a safe journey. Any additional related fee's (Microchip, additional shots, rabies vaccinations, quarantine kenneling fee's Etcs) will be charged to the buyer. International shipping is available on a per quote basis.

DEPOSITS & PAYMENT: Puppy must be paid in full, 10 days prior to shipping or on the date of pickup. We only accept postal money orders, cash and Paypal. We do NOT accept other money orders, cashiers checks or personal checks. We accept credit cards through Paypal only. There is a Paypal fee of 3% per transaction. Deposits are $200, and is non-refundable and non-transferable should you decide to change your mind. Deposits are only accepted for puppies that are too young to go to their new homes at the time of purchase. Puppies/dogs over 10 weeks of age must be paid in full. Should your puppy become unavailable due to death while in my care, your deposit &/or payment can be returned or transferred to another available puppy or to a future litter. I feel that by the time you place a deposit or payment on a puppy, you are 100% sure about purchasing a Chihuahua from us. Therefore, I will NOT refund any deposits or payments just because you changed your mind! So please give serious thought to your decision to purchase When I receive your deposit , I consider that puppy sold and no other inquires can be made on that puppy.

REGISTRATION: All our puppies come with AKC registration unless otherwise stated. All our puppies are to be registered with our kennel name. Buyer agrees to add "POFAHLS" prefix to the beginning of the AKC registration papers. All puppies are sold with limited AKC registration unless pre-approved for full AKC rights. AKC registration papers will be sent to the Buyer after the veterinary exam and acceptance of the Chihuahua by the Buyer. Breeder/seller has 30 days after purchase to furnish AKC papers to the buyer unless otherwise noted: ________________________________________________________________________________________

Q: What does limited registration mean?
A: Limited AKC registration basically means you will not be able to AKC register any offspring produced by this dog. Dog will also NOT be eligible to show in the AKC conformation show ring.

SIZE, TEMPERAMENT, SHOW AND BREEDING ABILITY: IS NOT GUARANTEED! We cannot guarantee sizes of adults: we give estimates. Some Chihuahuas can just stop growing and others get larger than expected. Guessing how big a few week old puppies size at adult age is like trying to guess a human babies height at 2 months old. I base my expected adult weights based on several factors including size of parents, lineage, previous litters Etcs. I cannot guarantee the temperament of a puppy either because I have no control of training & socializing once the puppies leave my care. I cannot guarantee a Chihuahuas ability to breed. Puppies sold as show prospects may or may not be show quality once they enter adulthood, again this is impossible to determine with a 2 month old human child whether or not they will be super-models as adults. However, there are certain qualities that I look for in a young pup that would indicate a good chance they could be a showable dog.

KENNELING COST: Should the buyer need to reschedule shipping or pick up date or require the Breeder/Seller to hold the puppy for longer than 48 hours to arrange pick-up or shipping; there is a $5 per day kenneling fee. There is no kenneling cost for puppies under 10 weeks of age. Any health care costs incurred during this period including but not limited to; Vet visits, vaccinations and dewormings that need to be administered during this kenneling time will be at the buyers expense. This fee is applied to any quarantine time needed to ship a dog/puppy internationally.

RE-HOME POLICY: Very occasionally circumstances are such that a puppy does not work out in its new home. Or maybe later on circumstances arise where the person can no longer care for their adult dog. In these or other similar situations we are happy to take the puppy or adult dog back until a new home can be found, but we do not offer exchanges or refunds, so please give serious thought to your decision to purchase.

THE BUYER AGREES TO:

•Have their puppy/dog examined by a licensed veterinarian within 72 hours of purchase or they agree to forfeit any warranty.

•Vaccinate their puppy/dog properly and maintain up to date vaccinations, regular routine worming and be on a heartworm preventative.

•Maintain a quality feeding program, fresh water, and to provide their puppy/dog with proper exercise and shelter at all times.

•Have their puppy/dog spayed or neutered at the earliest possible age or as recommended by their Veterinarian.

•Have their puppy/dog routinely vet checked.

•Limited Health Guarantee•

The 1 year limited health guarantee covers the cost of your dog only. We are not responsible for the associated charges, such as shipping, Paypal fee's, veterinarian fee's, mental stress & low blood sugar. This guarantee ONLY covers life threatening hereditary conditions that will severely affect the suitability of this dog as a pet. This guarantee is NOT for adult breeder dogs, rescued, retired or young adults/adults sold at 1 year of age or older. To qualify for the limited health guarantee, you must have your puppy examined by a licensed veterinarian of your choice within 72 hrs of the date of receipt of the puppy. (Starts at departure from my home for shipping or at time of pick-up from my home)
Conditions, diseases & disorders that are NOT covered but are not limited to the following:

Congenital defects/problems are not covered, only hereditary conditions are covered under this guarantee.
Open Fontanel also known as a Molera (A soft spot on top of the head), this spot may or may not grow completely closed in the Chihuahua. It is not a genetic defect but a unique feature of the Chihuahua.
Trachea in small breeds do sometimes develop a peculiar cough, this is due to the collapse tracheal rings, it is also known as reverse sneezing. Usually happens when pup gets excited.
Hernias (of any kind) unless life threatening
Testicles (not descending)
Luxation of the Patella Grade 1 or 2

Infectious Diseases & Parasites Including but not limited to Parvo, Distemper, Leptospirosa, Hepatitis, Corona, Bordatella (Kennel Cough), Worms, Mites, Giardia, Coccidia.

Hypoglycemia, Hypocalcaemia and other vitamin/food/nutrient deficiencies Breeder is not be responsible for deficiencies and disorders associated with poor diet. We feed our puppies "Royal Canin Puppy 33".Buyer has been made aware of this breeds susceptibility to hypoglycemia and has been provided with verbal courses of treatment for the condition. Therefore, seller will not be responsible for the puppy becoming hypoglycemic resulting in death or illness.

Seller does not guarantee temperaments, breeding abilities, size, coat, color, bites or quality of show whether or not AKC registered. This includes all faults of any kind.

Should the puppy be diagnosed within 1 year of any congenital/hereditary disorders which is considered by two unassociated veterinarians to seriously impact the quality of life, short of euthanasia, we will provide the buyer with these options:
1. Should the buyer choose to keep the puppy and accept a partial refund, with the receipt of spay/neuter and return of AKC papers signed for transfer, a refund of 50% of purchase price will be given less any shipping, Paypal, Veterinarian fee's and associated charges. You will receive 50% of your purchase price only.
2. Should the buyer choose to give up ownership of the puppy to us, we will replace the puppy of equal value or refund the purchase price less any Veterinarian, Paypal, shipping charges & associated fee's. AKC registration papers must be signed with a transfer to us.
LIMITATION OF LIABILITY:
In no event will Breeder be liable for any incidental or consequential damages including, without limitations, loss of profit and claims of third parties, however caused. All questions concerning the validity, operation, interpretation and construction of this Agreement shall be governed by and determined in accordance with the laws of the State of California. In the event that any one or more provisions contained in this Agreement should, for any reason, be held to be unenforceable in any respect under the laws of any state or of the United States, unenforceability shall not affect any other provisions of this Agreement, but this Agreement shall be construed as if such unenforceable provisions had not been contained herein. This contract is under the jurisdiction of the state of California, in the county of Los Angeles. It is agreed the place of venue shall be in Palmdale, California. Any breech of this contract could be detrimental to the name and reputation of the breeder/seller and the breeder/seller will be entitled to 5 times the purchase price of the puppy including but not limited to attorneys fees, court cost, any and all expenses acquired and (or) the puppy back. All other states and counties are asked to please accept this contract as legally binding and enforceable. This guarantee is non-transferable.
